Negligence is a tort law and comes under tort law which means that a tort has been committed (Tort and Negligence, 2012). The American civil justice system defines the law of torts as situations that occur when one party's wrongful conduct causes harm to another individual (WiseGeek, 2003). The responsible party is not acting as a reasonable person towards someone to whom he or she owes a duty, as required by law in the circumstances. Negligent torts are not committed intentionally and there must be harm resulting from the breach of duty (Negligent Tort Law, 2014). A negligent tort is caused by careless behavior and this includes a person's failure to practice due diligence and the negligence committed can be very costly to the company and if a product manufacturer causes death or injury as a result of the use of the company's products, the end result will be a costly and time-consuming legal action. From the negligent act a company could be publicly exposed, which could result in a loss of profit due to consumers' fear or refusal to purchase the product, and the value of the shares could decline if the company goes public. This can be very harmful to a company and may eventually force it out of business (Seaquist, 2012). Examples of civil liability include assault, harassment, assault, defamation, and trespass. To summarize, a tort case depends on breach of duty and to prove negligence in a civil court three elements such as duty, breach and damage must be proven (Tort and Negligence, 2012).
