Topic > Eighth Amendment Review - 887

The Bill of Rights is a very important document for American citizens. The Bill of Rights is the initial part of the American Constitution consisting of the first ten amendments that establish our fundamental rights as citizens of the United States. It guarantees us our freedoms which cannot be taken away from us. However, I believe that among the ten amendments there is a certain type of amendment that should be reviewed; this would be the eighth amendment. The Eighth Amendment states: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.” (Legal dictionary). I believe this is the only amendment that needs to be revised in the Bill of Rights. I think if someone were to commit a horrendous crime, in some extreme cases excessive bail and fines or cruel and unusual punishments might be necessary. I'm not saying it's okay for someone to be beheaded, burned alive, or publicly dissected (Cornell law), but some minor things might be somewhat acceptable. However, I find it very reasonable to hold someone with excessive bail and/or fines. I think it is very fair for the government to set extremely high bail or fine for someone who commits certain crimes. If I could personally rewrite the Eighth Amendment, I would write it like this: “Excessive bail or fines should not be imposed unless appropriate to the crime committed, nor should cruel and unusual punishments be imposed unless the need arises in the place where the crime was committed." extreme enough for all members of the jury to agree on cruel or unusual punishment. I think the Eighth Amendment should be revisited because the extreme crimes that are being committed now are so much worse than… middle of the paper… in some people's opinion it would be a horrible idea, but I think if should someone make people suffer and subject them to absolute misery, he should not be let off the hook very easily. So instead of the Eighth Amendment being “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishment inflicted.” (Legal dictionary), should be “as” Excessive bail or fines should not be imposed unless they are suited to the crime committed, nor should cruel and unusual punishments be imposed unless the need arises where the crime was enough extreme for all members of the jury should agree to cruel or unusual punishment.”.Works CitedLegal Dictionary.
